Personal Property Terms and Conditions

By registering to bid, placing a bid, or participating in this auction in any manner, you acknowledge that you have read, understand, and agree to be bound by these Terms and Conditions, as well as any auction-specific notices, announcements, or addenda posted before the auction closes.

1. Buyer’s Premium

A 15% buyer’s premium will be added to the final high bid and included in the total purchase price.

2. Sales Tax

Sales tax will not be collected unless required by applicable law. (No Sales Tax For this Auction)

3. As-Is, Where-Is Sale

All items are sold AS IS, WHERE IS, with all faults, defects, and imperfections, whether known or unknown, and with no warranties or guarantees of any kind, express or implied. All sales are final.

4. Descriptions and Inspection

All descriptions, photographs, dimensions, counts, conditions, authenticity statements, ages, brands, and other information are provided as a convenience only and are not guaranteed. Buyers are responsible for inspecting items when inspection is available and for determining condition, value, authenticity, and suitability before bidding.

5. Bidder Responsibility

It is the bidder’s responsibility to review all lot information, photos, pickup terms, shipping availability, and any posted updates before bidding. NeXstep Real Estate & Virtual Estate Sales is not responsible for bidding errors or omitted information.

6. Auction Closing

This auction uses a soft-close format. If a bid is placed within the final five (5) minutes before a lot closes, the closing time will automatically extend by one (1) minute. This process continues until no additional bids are received within the extension period.

7. Payment Terms

Successful bidders authorize NeXstep Real Estate & Virtual Estate Sales to charge the card on file immediately after the auction closes unless another approved payment method is required. Invoices for coins, precious metals, or other designated items totaling more than $500 must be paid by bank wire or certified funds unless the bidder is an established customer in good standing. If payment is declined, reversed, disputed, or otherwise not completed, the bidder remains responsible for the full invoice amount and any collection costs permitted by law.

8. Pickup and Removal

All items must be paid for in full before removal and must be picked up only during the published pickup dates, times, and location unless the auctioneer approves another arrangement in advance. Buyers are responsible for all labor, tools, packing materials, equipment, loading, dismantling, and transportation.

Wednesday, May 6th from 9:00am - 3:00pm EST

Thursday, May 7th from 9:00am - 3:00pm EST

Friday, May 8th from 9:00am - 3:00pm EST

Saturday, May 9th from 9:00am - 3:00pm EST

9. Missed Pickup and Abandonment

If items are not picked up during the designated pickup period, the buyer forfeits all rights to the items. NeXstep Real Estate & Virtual Estate Sales may charge cleanup, handling, storage, disposal, or relisting fees and may resell, donate, discard, or otherwise dispose of unclaimed items without refund or liability.

10. Shipping

Shipping may be available for select smaller items only. Buyers are responsible for all shipping, handling, packaging, insurance, and related charges. NeXstep Real Estate & Virtual Estate Sales is not a carrier and is not responsible for damage, delay, loss, or theft during transit.

11. Risk of Loss

Risk of loss transfers to the buyer when the item is declared sold. From that point forward, the buyer assumes all responsibility for the item, including any loss, theft, damage, or destruction, except where liability cannot be excluded by law.

12. Post-Purchase Injury and Hold Harmless

Buyer acknowledges that certain items may be unsafe or may require inspection, assembly, installation, maintenance, training, or proper operation. Buyer assumes all responsibility for the use, transport, installation, operation, and condition of any item after purchase. To the fullest extent permitted by law, Buyer agrees to indemnify, defend, release, and hold harmless NeXstep Real Estate & Virtual Estate Sales, the seller, the property owner, and each of their agents, owners, employees, contractors, and representatives from any claims, injuries, losses, damages, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to the buyer’s possession, use, loading, transport, installation, resale, or operation of any purchased item after the sale.

13. Accidents and Liability

All persons attending preview, pickup, loading, or otherwise entering the premises do so at their own risk. Neither the seller, the property owner, nor NeXstep Real Estate & Virtual Estate Sales is responsible for accidents, injuries, or damage to persons or property occurring before, during, or after the auction or during pickup.

14. Technical Issues

NeXstep Real Estate & Virtual Estate Sales is not responsible for server outages, software errors, internet disruptions, platform failures, delayed notifications, or other technical issues. In the event of a technical problem, NeXstep may extend, pause, reopen, cancel, or otherwise adjust bidding in its sole discretion.

15. Force Majeure

NeXstep Real Estate & Virtual Estate Sales shall not be liable for any delay, suspension, extension, cancellation, non-performance, or failure to complete any part of the auction caused by events beyond its reasonable control, including but not limited to severe weather, natural disaster, fire, flood, power outage, internet outage, software failure, labor dispute, strike, civil unrest, epidemic, pandemic, act of God, governmental order, emergency, or other force majeure event. In the event the auction or any lot is canceled or cannot be completed due to such an event, NeXstep may, in its sole discretion, extend the auction, reschedule the auction, cancel the auction, or void affected bids or sales. To the fullest extent permitted by law, any refund owed as a result of such cancellation or voided sale shall be limited to the amount actually paid by the buyer for the affected lot(s), and NeXstep shall not be liable for any consequential, incidental, special, or indirect damages.

16. Bidder Verification

All bidders are subject to verification. Bidding privileges are provisional until registration is approved. NeXstep Real Estate & Virtual Estate Sales may reject any registration, deny bidding privileges, or suspend an account at any time, in its sole discretion, for any reason permitted by law.

17. Reserve Prices, Conditional Sales, and Reserve Bids

Some items may be subject to reserve prices or seller approval. If an item is offered subject to seller approval, the high bid is considered an offer and is not accepted until confirmed by the seller or auctioneer. The auctioneer reserves the right to bid on behalf of the seller on any item offered with a reserve price, in accordance with applicable law and with disclosure as required by law or platform rules.

18. Auction Company Rights

NeXstep Real Estate & Virtual Estate Sales, the seller, and their agents or representatives may bid on items in this auction unless prohibited by law or specifically stated otherwise in the auction listing. NeXstep may also reject any bid, withdraw any lot, remove items from the auction, correct listing errors, or cancel the auction before final settlement, with or without notice, to the extent permitted by law.

19. Governing Law and Venue

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Tennessee. Any dispute arising out of or relating to this auction or these Terms and Conditions shall be brought exclusively in Hamilton County, Tennessee, and each party waives the right to a jury trial to the fullest extent permitted by law.

20. Entire Agreement

These Terms and Conditions, together with any auction-specific notices, addenda, and announcements, constitute the entire agreement between the bidder and NeXstep Real Estate & Virtual Estate Sales with respect to this auction. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
